BOOKING TERMS & CONDITIONS

Please read these booking conditions carefully as they are the sole terms and conditions of the contract between you and Fitness4Malta for all bookings. If you disagree with any part of the Terms & Conditions, please do not proceed with your Malta Holiday booking.

Any booking placed by means of the website Fitness4Malta tacitly implies your acceptance with these terms and conditions, in their entirety.

LAW AND JURISDICTION

Fitness4Malta is registered in Malta and the services offered are governed by the applicable laws of Malta. By using this website you agree that any dispute arising out of such use is subject to the laws of Malta and will be subject to Arbitration in Malta under the provisions of the Malta Arbitration Act. The language of any arbitration proceedings shall be English. One arbitrator shall be appointed by the Malta Arbitration Centre. Malta shall be the seat of arbitration.

OUR CONTRACT

All direct bookings are made with Fitness4Malta acting as an operator in partnership with Limas Trading Limited, company no: C-66028. In no case will Limas Trading Ltd incur any liability under these terms and conditions and/or with regards to any contract completed by you with regards to your use of this website and/or the services purchased herunder. Fitness4Malta is licensed as an operator to provide the services as offered hereby.

Most of the services provided are tailor made so you are able to make online requests about our services and make a booking according to your specific requirements.

UPDATING OF TERMS AND CONDITIONS

Fitness4Malta reserves the right to modify these Terms & Conditions Agreement at any time and without notice.

The information and prices shown in this website are subject to changes and therefore you must ensure that you check all details at the time of booking. It is your responsibility to check before booking, that the services offered through our website meet your specific requirements.

PRICES

All prices listed are per person and are all in Euros unless otherwise stated. Our prices may vary at any time in accordance with demand, market conditions and availability. Once you have received a quote the price will be locked in provided you pay the required deposit prior to the quote’s expiry. Any reduced pricing or discounts that may become available after you have paid your deposit will not apply.
Prices are based on currency exchange rates from the day of booking (source: oanda.com).

LIMITATION OF LIABILITY

Fitness4Malta acts only as a booking agent to the relevant service provider, for any accommodation, transport, guide service, attraction and/or any other event or service.

Fitness4Malta contracts with a network of companies and individuals to assist in the running of our Malta Fitness & Adventure Holidays Packages and simply acts as an agent for these third parties. We are not responsible for the acts and omissions of such third parties. Your relationship with Fitness4Malta is simply in obtaining a package holiday. The items included in the package holiday are provided by the above mentioned third parties.

Therefore you shall indemnify Fitness4Malta and hold such entity and its officers, employees, agents and representatives harmless from any liability and expressly waive any claims you may have to the fullest extent permitted by law for:

– any liability for any loss, death, injury or damage which you may suffer (directly, indirectly and/or consequentially) in connection with and/or arising out of your participation in a Malta Fitness & Adventure Holidays Package,
– you release us any liability arising out of or in connection with your participation in a Malta Fitness & Adventure Holidays Package; and

– any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded.

Fitness4Malta shall only assume liability insofar as a breach of its obligations under these Terms and Conditions has occurred.

ACCEPTANCE OF RISK

You acknowledge that the nature of the Malta Fitness & Adventure Holidays Package is adventurous and participation involves a degree of personal risk and good physical health. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.

OPTIONAL ACTIVITIES

Optional activities not included in the Malta Fitness & Adventure Holidays Package price do not form part of this contract. You accept that any assistance given by your local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and activity provider.

PAYMENT

We accept payment by transfer to our bank account or by PayPal. The relevant bank account will be communicated to you by email after your request for safety reasons. We are responsible to provide you with the relevant proof of payment immediately after we receive payment. The full amount must be paid in advance in order to confirm your booking.

YOUR DETAILS

In order for us to confirm your travel arrangements you must provide necessary details including full name as per passport, date of birth, phone number, e-mail address, nationality, and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. Your booking cannot be confirmed without provision of these details.

After you have booked your holiday with us we may pass on your contact email address and telephone number to the hotel or organisers for reasons to ensure pre-reading material, health concerns or holiday preferences can be organised.

BOOKING AMENDMENTS

If you wish to transfer from one Malta Fitness & Adventure Holidays Package to another or transfer your booking to a third party you must notify us at least 14 days prior to the proposed departure date. A fee of EUR 50 per person per change will apply (in addition to any charges levied by hotels or ground supplier). No amendments are permitted to your booking within 7 days of departure.

CANCELLATION BY YOU

If, for any reason, you decide to cancel your booking at least 14 days prior your arrival in Malta, the full amount will be returned to your account minus the operational cost of money transfer implied by service provider.
If you leave Malta Fitness & Adventure Holidays Package for any reason after it has commenced you will not be refunded for unused services. If you fail to join your Fitness or Adventure Holidays, join it after departure, or leave it prior to its completion, no refund or rebate will be made.

CANCELLATION BY US

We may have to cancel a Malta Fitness & Adventure Holidays Package at any time prior to departure if, due to external events it is not possible for us to operate the planned itinerary.

If we cancel your Holidays in Malta, you can transfer amounts paid to an alternate departure date or alternatively receive a full refund. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visa, travel insurance excess or non-refundable flights.

SMALL GROUPS & COMBINATION PACKAGES

Our Fitness or Adventure Holidays in Malta are guaranteed to commence once they have two fully paid travellers. If you would like to know how many people are booked on your Malta Fitness & Adventure Holidays Package or any combination Malta Fitness & Adventure Holidays Package it is part of please ask prior to making your booking.

HEALTH REQUIREMENTS

Age
Minimum age is 12 for Mega Adventure, City Break, Diving Holidays and 18 years for Fitness Holidays at the time of travel .

Health
It is your responsibility to advise us of any medical of heath conditions that may affect your participation in holiday and/or programme, failing to do so may result in aspects of your holiday being altered or cancelled.

TRAVEL DOCUMENTATION

It is your responsibility to ensure that you are in possession of valid I.D., or other travel documentation required to enter Malta. We are not responsible if you are refused entry to Malta because you lack the correct passport, visa or other travel documentation.

TRAVEL INSURANCE

Travel insurance is highly advised for all our travellers and should be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and other emergency situations.

CHANGE OF ITINERARY

Before departure:
While we endeavour to operate all Malta Fitness & Adventure Holidays Packages as described we reserve the right to change the Malta Fitness & Adventure Holidays Package itinerary. Please refer to our website before departure for the most recent updates to your itinerary.

After departure:
We reserve the right to change an itinerary after departure due to local circumstances caused by the weather or other events outside of our control. We are not liable for any forced cancellations or changes that stem from adverse weather conditions, acts of God, fire, floods, civil strife or riots, sickness, strikes, airport closures or any other circumstance that is beyond our control resulting in force majeure.

AUTHORITY ON TOUR

Our group Malta Fitness & Adventure Holidays Packages are run by a group guide/ instructor/trainer. The decision of the group guide/ instructor/trainer is final on all matters likely to affect the safety or well-being of any person participating in the Malta Fitness & Adventure Holidays Package. If you fail to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group guide/ instructor/trainer may direct you to leave the Malta Fitness & Adventure Holidays Package immediately, with no right of refund.

YOUR RESPONSIBILITY

Please remember that you are responsible for your actions and all members under your booking. If it is believed that any member of your party causes offence, distress, danger, damage or annoyance to either other guests, staff or property, we may terminate your booking and holiday with immediate effect. Thereafter we will not take responsibility for any party member; our contract with you will be terminated and the full cost of the holiday forfeited without any compensation or refund or expenses you may incur.

PROBLEMS AND COMPLAINTS

If you have a complaint whilst you’re on holiday, please bring this to our attention immediately so you have the best chance of resolving your issue; failure to do so may hinder any claim you wish to make on return. If you are still unable to resolve your issue please contact us so that we can be best equipped to help you whilst you are away. If you wish to complain on return, you must do so within 28 days from the day of arrival back home.
